Arizona Trust Certification
In 2018, the Arizona legislature updated Arizona’s Certification of Trust law in two important areas.
First: This updated law prohibits third parties, such as banks, brokerage firms, and title companies, from requiring trustees to disclose the names of successor trustees unless the third party provides a verified statement justifying their request.
Second: This updated law also increases the monetary penalties for those third parties who disregard the law. Arizona’s updated law can be found at A.R.S. 14-11013. Subparagraphs E and H of Arizona’s updated law are the most noteworthy enhancements.
