Arizona recently updated its Certification of Trust law in two important areas. This updated law prohibits third parties from requiring trustees to disclose the names of successor trustees, unless the third party provides a verified statement justifying the request. The new law also increases the monetary penalties for third parties who disregard the law. Arizona’s updated law can be found at A.R.S. 14-11013. Subparagraphs E and H of Arizona’s updated law are the most noteworthy enhancements.
